You’ll remember that consent is one of the lawful bases for the collection of personal data by current data protection law. The GDPR revises the requirements where consent is used. But remember you only need to collect consent where you cannot rely on another legal bases or where it is the most appropriate lawful basis.

For most Schools consent will be needed only in limited circumstances. Examples of this are to take pictures of pupils for school magazines or send fund-raising letters to parents and school supporters.

GDPR requires that the consent that a school collects

  • Can be evidenced, so it needs to be captured electronically, in writing or recorded, a verbal consent is unlikely to be suitable.
  • Must be clearly distinguishable from any other matter requiring a signature
  • Must be intelligible, written in clear and plain language
  • Is an opt-in consent, don’t use opt-out consent or pre-ticked boxes
  • Can be withdrawn by the data subject and tell them how they can do this

Schools have 2 activities they need to complete to be GDPR ready

  1. Update all forms that collect personal data using consent. To do this you need to have a separate section for consent. Schools GDPR have included sample text for your forms in our documentation.
  2. Review the evidence for existing consents that you have gathered and decide if you need parents, supporters or staff to give you a new evidenced consent. This is particularly important for consent for marketing which would include fundraising.
